If you would like to book an order with Roland for the first time, we need the following information in advance so that we can add you as a customer in our database:

Customs clearance

Following details always required:

  • Commercial invoice with shipper and consignee
  • Packing list with indicated gross weight and net weight including number of packages
  • In future: Power of attorney from sender with valid EORI number (will be implemented by Roland within 2021 – customers with regular export bookings will be informed in advance)
  • Preference certificate(s) in case to be done in the course of export customs clearance

Following details always required:

  • Commercial invoice with shipper and consignee
  • Packing list with indicated gross weight and net weight including number of packages
  • Bill of Lading (with identical number of packages and GWT indicated on packing list)
  • Ocean freight and on carriage rate (if included on the commercial invoice, this must be shown as a separate invoice item)
  • Power of attorney from recipient with valid EORI number (if available a valid tax account, however, this is not mandatory)

 

Alternatively, following documents may be required or have to be available:

  • Preference certificates (EUR1, ATR, Form A) – These can be recognized if they are available to us in ORIGINAL at time of customs clearance (must be able to be presented in the event of an inspection)
  • Basic notices (household effects), declarations (embassy staff / UNO / IAEA) – basic notices must also be available in ORIGINAL as they have to be written off in the course of clearance at the customs office. Exemptions from customs duties when moving to the EU for the first time (+ passport + registration form) as well as declarations with number of files already assigned (= declaration number at the top right on the first page) by the ministry do NOT have to be in original, a colour scan is sufficient.
  • BFW certificates (import wood packaging materials from IN/CN/BY) a colour scan is sufficient
  • Other import licenses (BIO certificate, phytosanitary or border veterinary inspection certificates, etc.) always required in ORIGINAL

In principle, a power of attorney is required as proof of legitimation vis-à-vis customs, as this represents an authorization for clearance. Furthermore, data such as EORI number, tax account, AEO certification are specified on this in order to enable customs to check / compare the recipient data with the commercial invoice.

Furthermore, mandatory legal components between the final recipient and (customs) submitter, such as inspection, appointment or clearance / inspection via partners, are regulated on this.

The term “free of charge” (FOC) does not exist in customs law. Basically, every item / invoice item requires at least a pro forma value (if, for example, you can proof to have paid nothing for the item specified). A pro forma value is only valid if individual sample items, which in themselves do not represent any commercial value but are only imported for viewing, are shown as such on the invoice.

Sea freight and on carriage costs have to be disclosed for customs value calculation resp. the import sales tax (EuSt). The following applies: Foreign freight costs (sea freight) for the customs value calculation, total freight costs for the VAT calculation. If the sea freight is prepaid, this must be shown as a separate item on the commercial invoice.

It is more than unlikely that shipper knows about the on-carriage rates (from the EU port to the recipient) in advance; these costs must be shown separately for each customs clearance by the customer.

Basically yes, if the given foreign EORI number is entitled to input tax deduction in Austria. Handling without an EORI number has not been permitted in Austria since 2004. Only private individuals or associations can process without an EORI number.

Inspections are only commissioned by customs, not by the submitter. This can be done on the basis of the risk profiles of the imported goods or on the basis of a random generator which selects shipments for inspection according to a predetermined percentage.

In addition to clearance, Roland also offers inspection (for a fee). This is usually done as a random check with customs or, in rare cases, as a complete physical container unloading at the customs clearance terminal.

Tariff suggestions given by the shipper are at best guidelines. Since the submitter is liable for the correctness in Austria, these can only be used if they are correct.

Of course, shipper try to specify duty-free tariff numbers in the interests of the customer, but this can, if the inspection or a subsequent control / audit by the ministry determine that the tariff number (s) specified do not match, to additional claims and also lead to penalties.

These may arise on the basis of the ancillary service tariff transmitted with the offer. These can be, for example, costs such as additional tariff numbers, inspection, processing of preference certificates or notices, outsourcing from the customs warehouse or presentation commission.

Presentation commission will be charged if Roland’s tax account is used (i.e., if Roland pays the customs duties in advance). This amounts to 3% of the applicable duty rate and is charged in addition to the costs for import clearance and the ancillary services.

The commission does not apply if the consignee’s tax account or, in the course of a provider clearance, the freight forwarder’s tax account including the assumption of debt in accordance with Art. 231 is available.

An appointment by Roland is possible. However, this service requires authorization from Roland in the USP (Company Service Portal) and is chargeable. A written application through official channels has not been possible since January 1st, 2021, as the Austrian customs office has now finally switched to a digital system.
